EPA Announces New Actions Affecting Emissions From Mobile Sources
Last week, the U.S. Environmental Protection Agency (EPA) took two actions related to mobile source emissions under the Clean Air Act that represent the agency’s continued focus on transportation, climate change, and environmental justice.
On March 7, 2022, EPA announced newly proposed emission standards for heavy-duty vehicles and engines, which would apply starting in model year 2027. The proposed standards would reduce allowed emissions of nitrogen oxides from heavy-duty gasoline and diesel engines and set more stringent greenhouse gas standards for certain commercial vehicle categories. Beyond numerical reductions in emissions, the rule also indicates EPA’s broader shift in focus to environmental justice. (more…)
EPA Appoints Environmental Justice Advisor to Support Administrator’s Environmental Justice Goals
On February 8, 2022, U.S. Environmental Protection Agency (EPA) Administrator Michael Regan announced the appointment of Robin Morris Collin as Senior Advisor of Environmental Justice to the Administrator. This appointment is the most recent agency action in the EPA-wide effort to prioritize environmental justice. According to EPA, “Collin will advise Administrator Regan as the Agency works to advance environmental justice and civil rights in communities that continue to suffer from disproportionately high pollution levels, including low-income communities and communities of color.” (more…)
Texas Challenges EPA’s Ozone Nonattainment Designation for El Paso County
On Friday, the state of Texas and Texas Commission on Environmental Quality filed a petition for review in the U.S. Court of Appeals for the District of Columbia Circuit challenging the Environmental Protection Agency (EPA) November 2021 designation of El Paso County as a nonattainment area for ozone. EPA Adds Four New PFAS to Toxic Release Inventory, Continues Addressing Strategic Roadmap Goals
As part of its continued focus on per- and polyfluoroalkyl substances (PFAS) regulations, the U.S. Environmental Protection Agency (EPA) has added four PFAS substances to the Toxics Release Inventory (TRI) list, including PFBS (perfluorobutane sulfonic acid) and potassium perfluorobutane sulfonate as well as two compounds listed at by their chemical identifier numbers — CASRN 65104-45-2 and CASRN 203743-03-7. EPA Enforcement Division Releases 2021 Statistics, Highlighting Higher Penalties and Commitment to Environmental Justice
On January 20, the U.S. Environmental Protection Agency (EPA) Office of Enforcement and Compliance Assurance (OECA) released its annual enforcement results for fiscal year 2021. OECA’s report provides some indication of the Biden EPA’s priorities for enforcement. Notably, OECA secured higher civil penalty amounts and financial commitments to injunctive relief in 2021 than in each of the previous four years, which supports the expectation that administrative enforcement actions in key priority areas will continue to increase during the Biden administration. EPA to Initiate Rulemakings Addressing PFAS Under Resource Conservation and Recovery Act as “Hazardous Constituents”
The U.S. Environmental Protection Agency (EPA or Agency) announced that it will initiate two separate rulemakings to address PFAS (per- and polyfluorinated substances) under the federal Resource Conservation and Recovery Act (RCRA) — the law that provides EPA with authority to address hazardous waste from “cradle to grave.” EPA announced these policy proposals in response to a petition submitted to Administrator Michael Regan by New Mexico Gov, Michelle Lujan Grisham on June 23 requesting that the Agency take regulatory action to list PFAS either collectively or individually as “hazardous waste” under Subtitle C of the Act. PFAS Strategic Roadmap: EPA Releases Human Health Toxicity Assessment for “GenX” PFAS Chemicals
The U.S. Environmental Protection Agency (EPA or Agency) has released its final human health toxicity assessments for a subgroup of PFAS chemicals known as GenX (i.e., hexafluoropropylene oxide dimer acid and its ammonium salt). The Strategic Roadmap outlines a number of key actions EPA intends to take over the next three years, including rulemakings and technical reviews that will involve a number of the Agency’s offices. U.S. EPA Announces Further Regulation of Manufactured Goods Under Toxic Substances Control Act
In an announcement that portends substantial regulatory changes, the head of the U.S. Environmental Protection Agency (EPA) chemicals office announced a shift in policy to further regulate chemicals within manufactured goods or finished products. The change would mean that importers, manufacturers, and processors will need to know the chemicals in manufactured or finished goods and assess whether EPA restricts those chemicals. (more…)
